Terms and Conditions - BASF Tipping Competition (AFL) 2012 CONDITIONS OF ENTRY 1. GENERAL: 1.1 The promotion is open to residents of Australia and New Zealand who are BASF employees, distributors and trade customers, detailed in Condition 2. The minimum age of eligible entrants is 18 years. There is a limit of one entry per email address and one entry per person. 1.2 Information on how to enter, scoring and prizes forms part of these Terms & Conditions. Entries and Participants not complying with these Terms & Conditions of Entry are ineligible and the Promoter reserves its absolute right to disqualify any Participant from the Promotion if any entries do not comply with these Terms & Conditions of Entry. Entry into any Promotion is deemed to constitute acceptance of these Terms & Conditions. 1.3 The competition will commence on 24 March 2012. 1.4 The competition will close on 9 September 2012. 1.5 The competition will contain 24 separate Rounds for entry (“Tipping Weeks”) corresponding to the 24 Weeks/Rounds of matches of the AFL 2012 football season, excluding Finals (known as the “Regular Season”). 1.6 The Weeks of matches for the Regular Season are set out on the BASF Customer Footy Tipping websites: www.baslac.footytipping.com.au and www.glasurit.footytipping.com.au Entry into the Promotion is considered to occur when a Participant submits one or more tip(s) for any of the Matches available for any Round. Participant may make or change a tip for a given Match in a Round at any time prior to the scheduled starting time of that Match. 1.7 Within 72 hours following the completion of each ‘Tipping Week’ of matches, the winners name for the corresponding Tipping Week will appear on the Ladder page of the Tipping Competition section of the customer website, and will also be notified by BASF via email. 1.8 The names of the overall competition winners will appear on the Competition website from 9.00am AEST on 12 September 2012 and published in The Australian newspaper on 18 September 2012. 2. WHO MAY ENTER: 2.1 The only persons who may enter and be awarded prizes are detailed in Condition 1.1 and are classified into one of the following three (3) groups. The classifications are 1) BASF Glasurit Customers, 2) BASF baslac Customers, 3) BASF Glasurit Distributors. 2.2 All entrants eligibility to participate is at the discretion of BASF, who may at any time refuse or conclude entrants inclusion within the competition. Entries and Participants not complying with these Terms & Conditions of Entry are ineligible and the Promoter reserves its absolute right to disqualify any Participant from the Promotion if any entries do not comply with these Terms & Conditions of Entry. 2.3 Entrants must complete the competition registration form on the respective BASF Customer Footy Tipping websites at www.baslac.footytipping.com.au and www.glasurit.footytipping.com.au read these conditions and agree to be bound by these terms and conditions. Entrants must select a valid username and password at the time of registration. Entrants must enter their username and password each time they access the Tipping Competition website. 2.4 Entrants must select both: - the winning team or a draw for each match in a Tipping Week before the Tip cut-off deadline for the Tipping Week in question; and - the difference between the final scores (the “Margin”) of their Tipped winning team and the other team playing the nominated match (known as the “Margin Match”) in the text box next to that match before the cut-off deadline for the Tipping Week in question. 3. SCORING / POINT ALLOCATION: Participants will be allocated one (1) point towards their Score for each correct selection of a Match. In the event of a Match in a given Round being drawn, cancelled, abandoned, not completed or not played for any reason and/or a Result is not officially declared within three (3) days of the date the Match was originally scheduled to be played, it is treated as a win for both teams competing in that Match for the purposes of calculating each Participant’s Score. 4. WEEKLY RANKING AND MONTHLY WINNERS: 4.1 In order to determine the results in each Round (week), Participants will be ranked: (a) firstly by their Score, where the highest Score has the highest rank; then, (b) in the case of a tie, by each Participant’s Weekly Margin for the same Round, where the lowest Weekly Margin has the highest rank; then, (c) in the case of a further tie, by each Participant’s Total Margin for the Season to date, where the lowest Total Margin has the highest rank; and then, (d) in the case of a further tie, the Participant who initially registered to participate (in the current Season) has the higher rank. 4.2 Weekly rankings for a given Round will be determined no later than 72 hours after the last Match of the particular Round has ended. 4.3 Monthly Winners: at the end of each full Tipping month – April 30, May 31, June 30, July 31 and August 31, the entrant who has tipped and scored the highest number of points and is at the top of the tipping ladder (calculated in accordance with the method set out in clause 3.0 and ranked in 4.1 above) will be the “Monthly Winner”. Winner will be determined at ExtraCorp Pty Ltd ABN 40 091 402 327 (“ExtraCorp”), 339 Queensberry Street, North Melbourne, VIC 3051. In the event that there is a tie between entrants with the same highest number of points for that tipping month, the monthly winner will be the entrant who has correctly Tipped the Margin Match and selected the Margin equal to or closest to but less than the actual Margin of the Margin Match of the for each week of the month in question. In the event that there is still a tie between entrants, the entrant who saved their last Tips first, will be declared the monthly winner (the last Tips Saved time is shown underneath each Week’s saved Tips). 4.4 Following the completion of each Tipping Week of matches, the name of the top tipper for the week will appear on the Ladder page of the Tipping Competition website, and will also be notified by BASF via email. 5. OVERALL RANKING / DETERMINING OVERALL WINNERS: 5.1 The ranking of end of the AFL Season place winners will be determined: (a) firstly, by the Participant’s total Score for all Rounds, where the highest Score has the highest rank; then, (b) in the case of a tie, by each Participant’s Total Margin for the Season, where the lowest Total Margin has the highest rank; then, (c) where Participants have identical Scores and identical Total Margins, the Participant with the lowest weekly Weekly Margin for the last Round within the Season will be ranked highest; and: (d) in the event of a further tie, the process in paragraph (c) will apply to the Weekly Margin in each preceding Round, in reverse chronological order, until the tie is broken. 5.2 End of Season rankings will be determined no later than 72 hours after the final Round of the Season has been completed. 5.3 Place Winners: At the completion of the Regular Season, the entrant with the overall highest number of total points (calculated in accordance with the method set out in clause 6.1 above) will be the “First Place Major Prize Winner” and be awarded the major prize. The entrant with the second (2nd) overall highest number of total points (calculated in accordance with the method set out in clause 5.1 above) will be the “Second Place Prize Winner”. In the event of a tie for the overall highest points, the First Place Winner will be the entrant who has correctly Tipped the Margin Match and selected the Margin equal to or closest to but less than the actual Margin of the Margin Match of the last Tipping Week. In the event that there is still a tie between entrants, the entrant who saved their last Tips for that Tipping Week first, will be declared the First Place Winner (the last Tips Saved time is shown underneath each Week’s saved Tips). Winners will be determined at 9.00am AEST on 10 September 2012, at ExtraCorp Pty Ltd ABN 40 091 402 327 (“ExtraCorp”), 339 Queensberry Street, North Melbourne, VIC 3051. 5.4 The names of the First Place and Second Place Winners will appear on the BASF Tipping Competition website from 12 September 2012 and published in The Australian newspaper on 18 September 2012. 6. PRIZES: 6.1 Winner Prize Schedule: BASF Group Prizes (all costs include GST) Group 1. Glasurit Major Prize: AFL Grand Final Experience valued at $1,500.00 (including travel) Runner Up Prize: AFL Team Polo Top valued at $49.95 and a Sherrin Football valued at $129.95 Monthly Prize: Vortex Glasurit jacket valued at $120.00 Group 2. baslac Major Prize: AFL Grand Final Experience valued at $1,000.00 (including travel) Runner Up Prize:AFL Team Polo Top valued at $49.95 Monthly Prize: baslac Polo Fleece Jacket valued at $60.00 Group 3. Glasurit Distributors Major Prize: AFL Grand Final Experience valued at $1,500.00 (including travel) Runner Up Prize: AFL Team Polo Top valued at $49.95 and a Sherrin Football valued at $129.95 Monthly Prize: Rebel Sport Gift Card valued at $50.00 6.2 A total of 21 prizes are to be awarded. The total value of all prizes: AUD$5,559.75 including GST. All prize items are valued inclusive of GST and the Promoter takes no responsibility for any variations in item values. The prizes are not transferable, exchangeable or redeemable for cash. In the event of that any prize item is unavailable, the Promoter reserves the right to substitute a prize item of equal or greater value subject to approval by state and territory regulatory authorities. Any taxes which may be payable as a consequence of a winner receiving the prize are the sole responsibility of the winner. 6.3 All prize items are valued inclusive of GST. 7. WINNER NOTIFICATION AND PUBLICATION: The winner will be notified in writing by mail and by email, using the details provided in their entry, and the name of the winners will be published as specified in Condition 1.8. 8. UNCLAIMED PRIZES: Unclaimed prizes will be held for three months. Should any prizes remain unclaimed after 5 December 2012, they’ll be re-awarded to the next eligible Tipster at 9.00am AEST on 10 December 2012 at ExtraCorp Pty Ltd ABN 40 091 402 327 (“ExtraCorp”), 339 Queensberry Street, North Melbourne, VIC 3051. All prize winners will be notified via email and in writing. It is a condition of the awarding of each prize that the winner must, if requested to do so by the Promoter, sign and return any Affirmation of Eligibility to Enter, Ownership of Entry, Release and Compliance statements provided to the winner by the Promoter. The failure to return the signed statements will result in the entitlement to the prize being forfeited and the selection of another winner. 9. REPRESENTATIONS / EXCLUSION OF LIABILITY: 9.1 The Promoter makes no representations or warranties as to the quality / suitability / merchantability of any of the goods/services offered as prizes. To the extent permitted by law, the Promoter is not liable for any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to the prize winner and, where applicable, to any family/persons accompanying the winner. 9.2 The winner and his or her guests must sign and return any liability release provided by the Promoter and/or its contractors as a condition of the prize being awarded. A parent or guardian who signs any liability indemnity provided by the Promoter as a condition of the prize being awarded must accompany a winner and any guests under 18 years. Failure to return the signed releases and indemnities will result in the entitlement to the prize being forfeited and the selection of another winner. This clause does not affect, and is not intended to affect, any rights a consumer might have, which are not able to be excluded under applicable Australian consumer protection laws. To the fullest extent permitted by law, any liability of the Promoter or its servant or agents for breach of any such rights is limited to the payment of the cost of having the prize supplied again. 10. INFORMATION: Information about Participants is used by the Promoter to assess and process registration in the Promotion. If an applicant does not provide the required information, the Promoter cannot process the registration. All entries become the property of the Promoter and will be entered into a database. Information emanating from the Participant's participation in the Promotion is used by the Promoter and its agencies associated with this Promotion, including but not limited to ExtraCorp Pty Ltd ABN 40 091 402 327 (“ExtraCorp”), for the determination of winners and distribution of prizes, if any, awarded to a Participant. Participants consent to publishing their name and Score in the results section of the Web Site and as otherwise set out in these Terms and Condition of Entry. The Promoter will not be held responsible for any loss of reputation, status or otherwise in connection with a Participant's tipping selections and consequential results. It is a condition of entry that Participants consent to these uses and disclosures of their information. Information about Participants may also be used by the Promoter, its agents, contractors and related companies, for the purposes of carrying out marketing, planning, product development and direct mail, telemarketing and promotional campaigns unless a Participant otherwise withdraws their consent to the use of their information in this manner. In the event there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and no correspondence will be entered into. The Promoter shall not be liable for any manufacturer defects in prizes or for any loss, damage or personal injury whatsoever which is suffered or sustained (including but not limited to indirect or consequential loss) as a result of taking a prize, except for any liability which cannot be excluded by law. 11. OWNERSHIP OF ENTRIES: All entries become and remain the property of the Promoter. 12. PUBLICITY: The winner consents to the use of his or her name, suburb of residence and image for promotional and marketing purposes and agrees to participate in reasonable promotional activities as requested by the Promoter. 13. INTERNET: If for any reason this competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion subject to the approval of all relevant State and Territory Lottery Departments, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the competition. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this competition. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR THE INFORMATION ON A WEBSITE, OR TO OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THIS COMPETITION, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, WHETHER SUCCESSFUL OR NOT, THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW. 14. To the extent permitted by law, the Promoter is not liable for any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to the prize winner and, where applicable, to any family/persons accompanying the winner. 9.2 The winner and his or her guests must sign and return any liability release provided by the Promoter and/or its contractors as a condition of the prize being awarded. A parent or guardian who signs any liability indemnity provided by the Promoter as a condition of the prize being awarded must accompany a winner and any guests under 18 years. Failure to return the signed releases and indemnities will result in the entitlement to the prize being forfeited and the selection of another winner. This clause does not affect, and is not intended to affect, any rights a consumer might have, which are not able to be excluded under applicable Australian consumer protection laws. To the fullest extent permitted by law, any liability of the Promoter or its servant or agents for breach of any such rights is limited to the payment of the cost of having the prize supplied again. 10. INFORMATION: Information about Participants is used by the Promoter to assess and process registration in the Promotion. If an applicant does not provide the required information, the Promoter cannot process the registration. All entries become the property of the Promoter and will be entered into a database. Information emanating from the Participant's participation in the Promotion is used by the Promoter and its agencies associated with this Promotion, including but not limited to ExtraCorp Pty Ltd ABN 40 091 402 327 (“ExtraCorp”), for the determination of winners and distribution of prizes, if any, awarded to a Participant. Participants consent to publishing their name and Score in the results section of the Web Site and as otherwise set out in these Terms and Condition of Entry. The Promoter will not be held responsible for any loss of reputation, status or otherwise in connection with a Participant's tipping selections and consequential results. It is a condition of entry that Participants consent to these uses and disclosures of their information. Information about Participants may also be used by the Promoter, its agents, contractors and related companies, for the purposes of carrying out marketing, planning, product development and direct mail, telemarketing and promotional campaigns unless a Participant otherwise withdraws their consent to the use of their information in this manner. In the event there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and no correspondence will be entered into. The Promoter shall not be liable for any manufacturer defects in prizes or for any loss, damage or personal injury whatsoever which is suffered or sustained (including but not limited to indirect or consequential loss) as a result of taking a prize, except for any liability which cannot be excluded by law. 11. OWNERSHIP OF ENTRIES: All entries become and remain the property of the Promoter. 12. PUBLICITY: The winner consents to the use of his or her name, suburb of residence and image for promotional and marketing purposes and agrees to participate in reasonable promotional activities as requested by the Promoter. 13. INTERNET: If for any reason this competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion subject to the approval of all relevant State and Territory Lottery Departments, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the competition. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this competition. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR THE INFORMATION ON A WEBSITE, OR TO OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THIS COMPETITION, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, WHETHER SUCCESSFUL OR NOT, THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW. 14.
